Devotion TAX SERVICES – CLIENT ENGAGEMENT AGREEMENT

1. Purpose of This Agreement

Thank you for choosing Devotion Tax Services to prepare your federal and state income tax return(s).

This agreement outlines the terms, responsibilities, and conditions under which we will provide services.

By signing this agreement, you authorize Devotion Tax Services to prepare and file your tax return for the requested tax year.

2. Scope of Services

Devotion Tax Services will:

    •    Prepare your federal and state tax returns based solely on the information you provide.

    •    Perform limited accounting as needed to prepare your return.

    •    E-file your return upon your signed authorization.

    •    Assist with refund transfer products and (if selected) refund advance applications.

    •    Provide copies of your return electronically through our secure system.

Devotion Tax Services will not:

    •    Audit, review, or guarantee the accuracy of your records.

    •    Detect fraud, misstatements, or illegal acts.

    •    Guarantee any refund amount or refund timing.

If we discover material errors or suspected fraud, we will notify you immediately.

3. Client Responsibilities

You agree to:

    •    Provide complete, accurate, and truthful information.

    •    Maintain all supporting documentation (W-2s, 1099s, receipts, mileage logs, childcare records, etc.).

    •    Respond promptly when additional information is needed.

    •    Review your return before signing.

You acknowledge that knowingly providing false information to Devotion Tax Services for reporting to the IRS may result in:

    •    IRS penalties

    •    Restitution

    •    Criminal charges

    •    Possible imprisonment

You waive Devotion Tax Services of liability for errors resulting from incorrect or incomplete information that you provide.

4. Fee Structure

    •    Tax preparation fees start at $350 and increase based on complexity.

    •    Self-employment, multiple states, rentals, investments, or advanced credits may increase fees.

    •    Fees are for services rendered and are due in full regardless of your refund outcome.

Non-Filing Fee

If we complete your return and you choose not to file with us:

    •    A $150 non-filing fee is due immediately.

    •    If the $150 is not paid, your full tax preparation fee becomes due.

5. Payment Options

A. Refund Transfer (Standard Method)

Most clients choose to have preparation fees deducted from their refund.

With this option:

    •    The bank creates a temporary account.

    •    Your IRS refund is deposited into that account.

    •    Tax prep fees, software fees, and bank fees are deducted.

    •    Remaining funds are released to you.

B. Upfront Payment

Upfront payment is required for:

    •    Amendments (1040-X)

    •    Returns with no refund

    •    Clients who decline the refund transfer

    •    Clients with past-due balances

6. Refund Advance (Optional)

Refund advances are offered through a third-party bank partner.

Approval Is NOT Guaranteed

The bank solely determines approval.

Devotion Tax Services does not influence or guarantee approval.

How Advances Work

A refund advance is an advance on your expected refund, not additional money.

Advance Levels

    •    $250–$1,000: No APR / no finance charge

    •    $1,250–$7,500: Finance charge (APR) set by the bank applies

If approved:

    •    Your advance is paid out first

    •    All applicable fees (tax prep, bank fees, software fees, APR) are deducted from your final IRS refund

If the Advance Is Denied

A denial only means you cannot receive refund money upfront.

You may still use the refund transfer option.

A denial does not cancel, reduce, or change your obligation to pay tax preparation fees.

7. Refund Offsets

You understand you are still responsible for all tax preparation fees if your refund is:

    •    Offset for child support

    •    Offset for student loans

    •    Offset for IRS or government debt

    •    Delayed for identity verification

    •    Reduced due to IRS review or audit

    •    Mailed instead of direct deposited

    •    Subject to PATH Act delays

Fees are owed regardless of refund outcome.

8. Abandoned Return Policy

You agree that the bank account you provide may be drafted a $100 processing fee if:

    1.    Your return is rejected because you already filed or obtained a loan elsewhere; or

    2.    We complete your return, notify you it is ready for signature, and you do not sign within 24 hours.

    •    Your return will be marked abandoned, and you may owe full fees.

9. Document Retention

    •    Your original documents will be returned to you.

    •    You must keep your own copies for future IRS verification.

    •    We retain electronic copies for 3 years, after which they may be destroyed.

    •    Paper copies can be provided for an additional fee.

10. Liability & Legal Action

If fees remain unpaid:

    •    Devotion Tax Services may pursue legal action

    •    Devotion may report the balance to all credit bureaus

    •    Devotion may use collection processes under applicable law

You agree not to dispute fees for services rendered due to IRS delays.

11. Electronic Filing Authorization

By signing, you authorize:

    •    Devotion to prepare and e-file your federal and/or state returns

    •    Your electronic signature to be applied to Forms 1040, 8879,

8867, 7216, and any supporting forms required to complete your return

12. Communication Consent

You agree to receive SMS text messages, emails, and phone calls from Devotion Tax Services regarding:

    •    Your tax return

    •    Required documents

    •    Updates or requests

    •    Future offers or opportunities

13. Agreement

By signing below, you confirm:

    •    You have read this entire agreement

    •    You understand the terms and fee structure

    •    You understand your responsibilities

    •    You authorize Devotion Tax Services to prepare and submit your tax return

    •    You accept all payment terms, refund terms, and non-filing/abandonment policies


CONSENT TO USE OF TAX INFORMATION

For the purposes of this consent form, “we,” “us,” and “our” team. Federal law requires this consent form to be provided to you.

Unless authorized by law, we cannot use your tax return information for purposes other than the preparation and filing of your tax return without your consent. You are not required to complete this form to engage in our tax return preparation services. If we obtain your signature on this form by conditioning our tax preparation services on your consent, your consent will not be valid. Your consent is valid for the amount of time that you specify. If you do not specify the duration of your consent, your consent is valid for one year from the date of signature. If you do not consent, you may still have your tax return prepared and electronically filed by us for a fee. For your convenience, we have entered into an

arrangement with third parties to provide qualifying taxpayers with the opportunity to apply for an Electronic Refund Disbursement Service and/or Loan product. To determine whether these products may be available to you, we will need to use your tax return information in order

to calculate the amount of your anticipated refund. If you would like us to use your tax return information to determine whether these products may be available to you while we are preparing your return, please sign and date this consent to the use of your tax return information, By signing

below, you authorize us to use the information you provide to us during the preparation of your 2025 tax return to determine whether to present you with the opportunity to apply for these products and services. If you believe your tax return information has been disclosed or used improperly in a manner unauthorized by law or without your permission, you may contact the Treasury Inspector General for Tax Administration (TIGTA) by telephone at 1-800-366-4484, or by e-mail at

CONSENT TO DISCLOSE

For the purposes of this consent form, “we,” “us,” and “our” team Devotion Tax Services, contractors, and affiliates.

Federal law requires this consent form be provided to you. Unless authorized by law, we cannot disclose your tax return information to third parties for purposes other than the preparation and filing of your tax return without your consent. If you consent to the disclosure of your tax return information, Federal law may not protect your tax return information from further use or distribution.

You are not required to complete this form to engage in our tax preparation services. If we obtain your signature on this form by conditioning our services on your consent, your consent will not be valid. If you agree to the disclosure of your tax return information, your consent is valid for the amount of time that you specify. If you do not specify the duration of your consent, your consent is valid for one year from the date of signature.

You have indicated that you are interested in receiving an Electronic Disbursement Service and/or Loan (or collectively, “Products or Services”) from Refund Advantage, a division of MetaBank, National Association. In order to provide you with the opportunity to apply for one of these Products or Services, we must disclose all of your 2025 tax return information necessary for evaluating the request to Refund Advantage. If you request a more limited disclosure of tax return information, you will not be eligible to submit an application request for these Products or

Once you complete and submit your application, please allow us up to 24 to 72 hours for virtual tax processing (most times sooner). You will be notified via text/email on the status of your application.
